Do I need a Zoning Permit?

Residential projects such as a new fence, deck, addition, pool, patio, gazebo, chicken coup, retaining wall, driveway, and similar structures require a Residential Accessory Structure/Addition permit prior to beginning any work. If you are performing maintenance that is a like-for-like replacement on a structure that is approved, a permit is not required.

 

How to Apply

To apply for a Residential Accessory Structure/Addition, you will need to provide,

  • Permit Application
  • Application Fee (see fee schedule for current fee amounts)
  • Drawing that accurately depicts the following; (examples are on page 3 of the application)
    • Lot
    • Current improvements (house, driveway, deck, shed, and other related items)
    • Adjacent rights-of-way (streets or alleys)
    • Any on-site easements
    • Proposed structure
      • Type of structure
      • Dimensions, including height
      • Setbacks of the proposed from property lines

The drawing can be hand drawn.  However, a House Location Survey or a Plat are preferred.  The drawing must reflect the current lot conditions and proposed improvements.

 

Staff will send by email, Comment Letters if the application is incomplete or does not meet the applicable regulations.  If approved, staff will send an email with the application stamped “APPROVED”.  This will act as your zoning permit.

Historic District Requirements

Repairs, alterations, and additions of properties within the historic district must follow the Historic District Guidelines.  Any new structure, addition, or modification of the existing design and materials, requires the submission of an Architectural Review Board application.  These applications will be reviewed by staff for compliance with the zoning ordinance.  The Architectural Review Board will hold a public hearing on the application and make their recommendations. This recommendation is required prior to commencing any work.  If there are any questions about your project and if it will require this process, please contact the Zoning Administrator.

 

Fences within town utility easements

During the review process, we may identify the proposed fence will be within a Town of Strasburg water or sewer easement.  A fence may be allowed to cross, but not run parallel within these easements.  If staff determines the condition is acceptable, staff will request a Hold Harmless Agreement will need to be submitted prior to the permit approval. 

 

Building Permit Requirements

Some of these projects will also require building permits that are issued by the Shenandoah County Building Department.  Upon approval of the zoning permit, the town will forward the approval to the county for their records.  This is required prior to the release of pending building permits related to the project.
